Sales and Return Policy

General Policy
Onethird Technology Pty Ltd ("Onethird") is committed to the highest standards of product integrity. Please choose carefully, as we do not offer refunds or exchanges if you simply change your mind, find the product cheaper elsewhere, or decide the product is not to your subjective liking.
Kickstarter and Pre-order Pledges
By pledging to our Kickstarter campaign or placing a pre-order, you acknowledge that you are supporting a product in development.
No Refunds on Pledges: Once the Kickstarter campaign has concluded and funds have been collected, all pledges are final. These funds are immediately committed to manufacturing, raw materials, and R&D for the SOMA units.
Cancellation: Cancellation requests made prior to the commencement of the manufacturing phase may be granted at our sole discretion and may be subject to a processing fee.
Health and Hygiene Restriction
SOMA is a sleep-related product designed for use in an intimate bedding environment.
Non-Returnable if Opened: For health and safety reasons, we cannot accept the return of any SOMA unit if the original factory seal has been broken or if the product has been placed on a mattress.
Used Goods: We do not resell used sleep products. Therefore, if a unit is returned and found to have been used, no refund will be issued unless required by the Australian Consumer Law.
Major Failure vs. Minor Failure
In accordance with the Australian Consumer Law:
Minor Failure: If the SOMA unit has a minor problem (e.g., a software bug or a replaceable cable), Onethird will offer to repair or replace the part within a reasonable timeframe.
Major Failure: You may choose a refund or replacement if the product has a "major failure." A major failure occurs when the product:
Would not have been acquired by a reasonable consumer if they knew the extent of the problem;
Is significantly different from the description or demonstration model;
Is substantially unfit for its common purpose and cannot be easily fixed; or
Is unsafe.
Shipping and Delivery
Ownership of the product passes to the backer/customer upon delivery to the carrier. Onethird is not responsible for delays caused by customs, international shipping ports, or local delivery services, though we will provide all reasonable assistance in tracking and recovery.
Governing Law
This policy is governed by the laws of Victoria, Australia. Any disputes arising from this policy shall be subject to the exclusive jurisdiction of the courts of Victoria.
